Description: The three parcels are the lands to sell. The irrigated parcels total 4.97 acres and the vacant parcel at the end of Marshall Street is 0.2837 acres. We are attaching a copy of the hay field survey and the Quiet Title Case that settles the issue of the lands being within the old fence line. lWe are selling a 2/7 interest in the Tatman Ditch Water Right. That 2/7 interest flows through the Delisa Ditch that is 100% owned by us and will be transferred with the irrigated parcels. The Delisa Ditch was destroyed. Comprised 2/3 of the Delisa Ditch length. That 2/3 length ditch will needs to be repaired in order to carry water to the parcels. The Tatman Ditch water is delivered into the Delisa Ditch and historically used through an agreement based on days of the week (the 2/7 interests being sold). The Delisa Ditch received water Tuesdays and Fridays in that agreement that l've attached documents. ln practice, the owners have all shared the water whenever it was the most beneficial for meeting the crop needs, ditch capacity and delivery efficiency. On average, The Tatman Ditch water right carries water between March 15 and November '1 each year for 180 days. Diversions outside that date range when water and weather allow. Peak flow is limited at the Tatman Head gate (photo available) to 1 cfs and on average, the variable flows in Oak Creek get diverted. The permitted well is 109 years old, and the steel casing has rusted through, partially collapsed down hole is presently unusable.
